Involuntary Leave of Absence Policy


It is the policy of Claremont Graduate University that if any student, because of an apparent medical or psychological condition poses a threat to the physical well-being to self or any other member of the Graduate University or Claremont Colleges community, or a threat of serious destruction of property, such student may be placed on an involuntary leave of absence. This policy applies to medical and psychological problems only, and not to matters solely of a disciplinary nature. 

PROCEDURES FOR IMPLEMENTATION OF POLICY ON INVOLUNTARY MEDICAL LEAVES OF ABSENCE

  1. When evidence is brought to the Dean of Students Office (hereafter the “Dean”) that the behavior of a CGU student poses a threat to the physical or psychological well being of the student or another individual, threat of serious damage to property, disruptive or dangerous behavior, the Dean may place the student on involuntary leave of absence for an appropriate period of time. The decision to place a student on an involuntary leave of absence is made in consultation with qualified University officials which could include; Campus Safety, Student Health Services and/or Monsour Counseling and Psychological Services. The term “disruptive or dangerous behavior” includes but is not limited to the following: Behavior that poses a threat to self, including but not limited to a suicidal attempt, gesture, or statement of suicidal attempt; Behavior that demonstrates an imminent, foreseeable or existing threat to the safety or well-being of a student, other member of the University community, or members of University-related programs on or off campus; Behavior that disrupts or interferes with the ability of other students, faculty or staff to participate in the educational programs, living environment, or employment opportunities offered by the University; Behavior that indicates that a student is unable to control their behavior or to perform the essential functions of a student. 
  2. The Dean of Students Office will notify the student in writing of this action. If the student agrees with the decision made by the Dean, no further action is necessary and procedures (5) through (7) will be followed.
  3. If the student believes that an error was made in issuing the involuntary leave, they must state so in writing to the Dean of Students Office, within 24 hours following receipt of notice. This statement should include new evidence that could affect the outcome and should not exceed one full page. 
  4. Students remaining on involuntary leave of absence for at least a full calendar year will be dismissed (involuntarily withdrawn) from the University. Students dismissed from CGU are not eligible for reinstatement, but may reapply through the Admissions Office in accordance with the Admissions Office policies. Students dismissed due to involuntary leave of absence, who are seeking Admission will be required to meet with the Dean of Students Office and provide documentation from a licensed medical provider on provider’s letterhead that in the provider’s judgment the student is ready to return to the rigors and stress associated with a graduate school environment, that the student presents no direct threat to self or others, and the student possesses the fitness and capacity to succeed in the degree program.
  5. The Dean of Students Office will evaluate the request and may consult with the student’s academic unit, medical provider(s), and other qualified University officials as they deem relevant to the Admission request, and will make a recommendation. To provide ample time for consideration, this process should be initiated by the student at least 30 calendar days prior to the start of the term.
  6. Questions regarding appropriate refund and payment of tuition and fees are left to the discretion of the Petitions and Appeals Committee.
